Ratio Decidendi

The court found that the Appellants had filed a review application in the lower court regarding the same orders they were appealing against. Section 80 of the Civil Procedure Act and Order 45 of the Civil Procedure Rules prohibit a party from seeking both review and appeal of the same order. Since the Appellants did not oppose the application to strike out the appeal and there was clear evidence of a pending review, the appeal was deemed defective and was struck out with costs. Consequently, the Appellants' application for injunction was also struck out as it lacked a substratum following the striking out of the appeal.
