Procedural Posture

Environment and Land Case / Ruling on Substitution Application

  1. 1 Whether the legal representatives of the deceased plaintiff should be substituted as parties to the suit.
  2. 2 Whether the application for substitution was filed within the prescribed time.
  3. 3 Whether the cause of action survives the deceased plaintiff.

Ratio Decidendi

The court held that the applicants, having obtained a limited grant of letters of administration ad litem and filed the application for substitution within one year of the plaintiff's death, satisfied the requirements for substitution under Order 24 of the Civil Procedure Rules. The cause of action survived the deceased, and there was no opposition to the application. The court therefore allowed the substitution of the deceased plaintiff with his legal representatives. Costs of the application were ordered to be in the cause.

Court Disposition

Application for substitution allowed.

Orders

  • The two applicants are allowed to substitute the deceased plaintiff.
  • Costs of the application shall be in the cause.
