The Court of Appeal found that the applicants satisfied the two-pronged test for stay of execution under rule 5(2)(b) of the Court of Appeal Rules: (1) the intended appeal is arguable, as it raises bona fide issues that are not frivolous and warrant full argument before the court; and (2) the appeal would be rendered nugatory if stay is not granted, as the applicants risk eviction and irreversible loss of substantial developments valued at KES 200 million, which cannot be adequately compensated by damages.
