Procedural Posture

Miscellaneous Application / Ruling on Application for Stay Pending Appeal

  1. 1 Whether the applicant is entitled to a stay of execution of the BPRT order of 1st April 2016 pending appeal.
  2. 2 Whether the appeal before the High Court is competent where the applicant was absent at the BPRT hearing and the matter was not determined on merit.
  3. 3 Whether the applicant should have first sought review or setting aside of the BPRT order before appealing.

Ratio Decidendi

The court found that the applicant was absent at the BPRT hearing, and the order dismissing his reference and granting vacant possession to the respondent was made solely due to his absence, without consideration of the merits. As such, there was no determination on facts or law, and the applicant should have first sought review or setting aside of the BPRT order before appealing. The appeal was therefore incompetent, and there was no basis for granting a stay of execution. The court emphasized the need to avoid unnecessary legal costs and to ensure expeditious and affordable resolution of disputes, in line with the overriding objective of the Civil Procedure Act.

Court Disposition

Application dismissed and appeal struck out.
