The Court found that Godfrey Samson Murithi acquired a valid title to the suit land as a beneficiary pursuant to purchase under a confirmed grant in Meru High Court Succession Cause 87 of 2008. The Defendants, having consented to the confirmation of the grant and the subdivision of the original land parcel, could not later challenge the validity of the title. The Plaintiff, having purchased the land from the registered owner and having no notice of any dispute or defect, was deemed a bonafide purchaser for value without notice.
