Ratio Decidendi

The conviction was fundamentally flawed because the trial magistrate relied on the statement of a hostile witness whose evidence had been expressly disregarded, rendering it inadmissible and unreliable. Furthermore, the appellant's constitutional rights were violated when he was detained in police custody for more than 30 days before being presented to court, contrary to Section 72(3) of the Constitution. The State failed to provide any explanation for this delay. Both the evidentiary and constitutional breaches independently and collectively rendered the conviction unsafe and necessitated the appellant's acquittal regardless of the prosecution's case strength.
