The court found that service of the notice of motion for judicial review was not properly effected on the County Secretary or an authorized agent of the County Government of Embu, as required by law. The process server served the receptionist at the Governor's office, who was not an authorized agent for service. Consequently, the respondent could not be said to have been aware of the proceedings. The court held that, although Order 53 does not expressly provide for setting aside ex parte orders, the court has inherent jurisdiction under Order 51 Rule 15 and Section 3A of the Civil Procedure Act to do so in the interests of justice.
