Ratio Decidendi

The court found that the police had completed their investigations regarding the motor vehicle and, as such, the purpose for which the vehicle was impounded had been fulfilled. The 3rd Respondent, having defaulted on the sale agreement and expressly conceding to the release of the vehicle, had relinquished any proprietary interest in it. There was no legal impediment to the release of the vehicle to the Applicant. The court further noted that all parties, including the Respondents, conceded to the application. Therefore, the court ordered the immediate release of the motor vehicle to the Applicant, with compliance directed to the DCIO, Kilimani Police Station.
