The only evidence of occupation was a plumbing certificate. In such circumstances, the trial magistrate should have reverted to the minimum wage as the multiplicand for loss of dependency, as supported by case law and the Regulation of Wages Order. The trial court's adoption of Kshs. 10,000/- as the multiplicand lacked evidentiary basis. The appellate court therefore set aside the multiplicand of Kshs. 10,000/- and substituted it with Kshs. 8,835/-, being the minimum wage for an ungraded artisan outside key urban areas, and recalculated the...
