The appellate court found that the trial court erred in declining to award damages for loss of dependency solely because the appellant did not know the name of the deceased's employer. The evidence established that the deceased was employed and supported his family, and the claim for loss of dependency was unchallenged. Applying a reasonable monthly income of Kshs.2,000, a multiplier of 20 years, and a dependency ratio of 2/3, the court calculated the award for loss of dependency at Kshs.320,000, less 25% for contributory negligence, resulting in Kshs.240,000.
