The Tribunal found that the statutory 60-day period for filing an appeal under section 129(1) of EMCA begins to run from the date the EIA licence is issued, not from the date the appellant becomes aware of or is notified of the decision. The Tribunal relied on its prior decision in Runda Association v NEMA & 3 Others and the express language of the statute and rules, which do not provide for extension of time in such cases. Since the EIA licence was issued on 19th September 2019 and the appeal was filed on 9th June 2020, the appeal was filed well outside the 60-day limitation period. The Tribunal therefore lacked jurisdiction to entertain the appeal and was compelled to dismiss it. The...
