Procedural Posture

Preliminary Objection / Ruling on Preliminary Objection Regarding Jurisdiction and Applicability of Employment Law

  1. 1 Do County Governors have the prerogative to hire and fire Members of the County Executive Committee in the same way as the President at the National level?
  2. 2 Is the Employment Act 2007 applicable to Members of the County Executive Committee?
  3. 3 Is the County Governments Act 2012, regarding firing of Members of the County Executive Committee, inconsistent with the pure Presidential System?

Ratio Decidendi

The Court held that Members of the County Executive Committee are political appointees serving at the pleasure of the Governor, analogous to Cabinet Secretaries at the National level who serve at the pleasure of the President. The prerogative to appoint and dismiss such officers is preserved under the Constitution and the County Governments Act 2012, and is not subject to the procedural and substantive protections of the Employment Act 2007 or other labour statutes. The Court found that the Employment Act 2007 does not apply to this special category of employees, and that the County Governments Act 2012 is not inconsistent with the pure Presidential System established by the Constitution....

Court Disposition

preliminary objection sustained; claim struck out

Orders

  • The preliminary objection is sustained to the extent stated in the ruling.
  • The Employment Act 2007 has no application in the removal of County Executive Committee Members.
