Ratio Decidendi

The court found that the Plaintiffs had fully paid the purchase price and the agreed surveyor's fees for their respective portions of the suit land. The 1st Defendant, who acted as advocate for the 2nd Defendant (the vendor), was not retained by the Plaintiffs and thus had no advocate-client relationship with them. The right of lien over completion documents can only arise in the context of such a relationship, which was absent here. The Plaintiffs' obligation was limited to paying the actual surveyor's fees, which they had done, and not any additional legal fees to the 1st Defendant. The 1st Defendant's claim for legal and sub-division fees from the Plaintiffs was therefore unfounded....
