Procedural Posture

Employment Cause / Ruling on Preliminary Objection

  1. 1 Whether the Employment and Labour Relations Court has jurisdiction to hear the claim before exhaustion of the appellate procedure under section 77 of the County Governments Act.
  2. 2 Whether the claimant's simultaneous pursuit of an appeal before the Public Service Commission and a court claim was proper.
  3. 3 Whether the failure to disclose the pending appeal to the Public Service Commission was material to the proceedings.

Ratio Decidendi

The court found that it lacked jurisdiction to entertain the claim because the claimant had not exhausted the statutory appellate procedures provided under section 77 of the County Governments Act and section 87(2) of the Public Service Commission Act. The claimant filed both an appeal before the Public Service Commission and the present court claim simultaneously, thereby failing to afford the Commission a sufficient opportunity to address the dispute. The failure to disclose the pending appeal was also material. The court upheld the preliminary objection and struck out the claim for want of jurisdiction.

Court Disposition

preliminary objection upheld; claim struck out for want of jurisdiction
