Ratio Decidendi

The court held that since the respondent did not dispute the retainer and the certificate of taxation dated 26th February 2021 had not been set aside or altered, Section 51(2) of the Advocates Act mandated the entry of judgment for the sum certified in the certificate of costs. The court found that the law regards such a certificate as a sufficient basis for judgment, and the respondent's opposition did not raise any valid legal ground to prevent the entry of judgment. Accordingly, judgment was entered for the applicant for the taxed sum with interest from the date of the certificate until payment in full, and the respondent was ordered to pay the costs of the application.
