Personal service is a strict requirement for contempt proceedings, as established by the Court of Appeal in Ochino & Another v Okombo & 4 others (1989) KLR 165. Without proof of such service, the court cannot find the Defendant in contempt. The Plaintiff's application is therefore denied.
