Section 26 of the Civil Procedure Act only empowers the court to award interest from the date of suit, unless there is a contractual or statutory basis for pre-suit interest, which was not established in this case. Therefore, the award of interest prior to the filing of the suit was set aside and substituted with an award of interest from the date of filing suit until payment in full.
