Procedural Posture

Miscellaneous Application / Post Judgment Application for Change of Advocate

  1. 1 Whether leave should be granted for a new advocate to come on record after judgment has been entered.
  2. 2 Whether the requirements of Order 9 Rule 9 of the Civil Procedure Rules have been satisfied.

Ratio Decidendi

The court found that the applicant had satisfied the requirements of Order 9 Rule 9 of the Civil Procedure Rules, which governs the procedure for change of advocate after judgment. The outgoing advocate had been appointed as a judge, and the applicants had engaged a new advocate, Ibrahim Alubala Advocates. The application was not opposed, and all procedural requirements were met. Accordingly, the court exercised its discretion to allow the application for change of advocate, granting leave for the new firm to come on record for the respondents/applicants in place of the previous firm.

Court Disposition
