Ratio Decidendi

The court found that the order allegedly contravened by the 1st Defendant specifically referred to L.R. No. 10029 Plot No. 19 as per the Plaint and Notice of Motion dated 12th July 2013. The present application, however, concerned L.R. No. 14801, a different parcel of land. The court held that the two parcels were not the same and that any actions by the 1st Defendant in respect of L.R. No. 14801 did not amount to contempt of the court order, which only applied to L.R. No. 10029 Plot No. 19. As such, the application for contempt could not be sustained and was dismissed.
