Ratio Decidendi

The court found that the applicant had complied with all statutory requirements under the Arbitration Act 1995 and the Arbitration Rules 1997 for enforcement of an arbitral award. The arbitral award, made by a duly appointed arbitrator, was final and had been filed in court. The respondent had failed to pay the awarded sum despite demand. There was no evidence of any procedural or substantive defect in the arbitration process or the award. Accordingly, the court granted leave to the applicant to enforce the arbitral award as a decree of the court, together with costs of the application.
