The respondent proved, on a balance of probabilities, that he fulfilled his contractual obligations and that the appellant breached the contract by failing to harvest and transport the mature cane. The respondent was entitled to compensation for the plant crop only, as the evidence on yields for ratoon crops was insufficient.
