The High Court found that the trial court failed in its duty to safeguard the integrity of the court record when it proceeded to determine the application without resolving the authenticity of the disputed documents. The trial court should have halted proceedings and referred the matter for investigation, rather than conditionally setting aside the ex parte judgment. The failure to address the origin and legitimacy of the documents prejudiced both parties and undermined the administration of justice. Consequently, the High Court allowed the appeal, set aside the ruling and all consequential orders, and directed that the matter be investigated by the Directorate of Criminal Investigations...
