Miscellaneous Appeal / Ruling on Application for Joinder and Taxation of Auctioneer's Costs

  1. 1 Whether the court has jurisdiction to entertain the application for joinder and taxation of auctioneer's costs after final determination of the main suit.
  2. 2 Whether the applicant is entitled to be joined as an interested party for purposes of recovering auctioneer's costs.
  3. 3 Whether the High Court or the Deputy Registrar is the proper forum for assessment of auctioneer's costs.

Ratio Decidendi

The court held that it lacked jurisdiction to entertain the application for joinder and taxation of auctioneer's costs because the main suit had already been finalized and the court was functus officio. The proper procedure for the applicant to recover his auctioneer's costs is to file a bill of costs before the Deputy Registrar for assessment, as provided under the Auctioneer Rules. The court further found that joinder of the applicant as an interested party was not warranted since the matter was no longer alive before the court, and Order 1 Rule 10(2) Civil Procedure Rules only applies to ongoing proceedings. Consequently, the application was dismissed as unmerited.
