Procedural Posture

Civil Suit / Ruling on Objection Proceedings to Attachment of Property in Execution of Decree

  1. 1 Whether the objector has a legal or equitable interest in the attached property sufficient to prevent its attachment in execution of the decree.
  2. 2 Whether the purchaser's caution registered prior to the prohibitory order gives the objector priority over the decree holder's interest.
  3. 3 Whether the sale agreement between the judgment debtor and the objector is valid and not a scheme to defeat the decree holder's rights.

Ratio Decidendi

The court found that the objector had established a purchaser's interest in the property by virtue of a sale agreement and registration of a caution prior to the decree holder's prohibitory order. The decree holder, having opted to sue and obtain a judgment rather than perfect its security, became an ordinary decree holder and not a secured creditor. The objector's interest, being registered earlier, took priority and was not tainted by any impropriety of the judgment debtor. Therefore, the property was not available for attachment in execution of the decree, and the objection succeeded.

Court Disposition

objection allowed; attachment of property set aside

Orders
