The court found that the applicant failed to provide a satisfactory explanation for the delay in filing the appeal, as it did not disclose the name of the former advocates, provide an affidavit from them, or show correspondence evidencing instructions to appeal. The applicant also failed to explain the three-month delay in bringing the present application. The court held that the delay was inordinate and inexcusable, and that equity aids only the vigilant. Consequently, the application for extension of time was devoid of merit. As the application for leave to appeal out of time was dismissed, the issue of stay of execution became moot and was not addressed.
