The court found that although the 2007 post election violence was unforeseeable and did disrupt the Plaintiffs' business, the contract was not frustrated because the Plaintiffs ultimately repaid the loans in full and the Defendant executed a discharge of charge. The Defendant acted lawfully in issuing statutory notices and instructing auctioneers while the Plaintiffs were in default. However, once the loans were repaid and the discharge executed, the Defendant's failure to communicate with the auctioneer was a procedural lapse but did not entitle the Plaintiffs to damages. The Defendant was not entitled to recover auctioneer and legal costs from the Plaintiffs as there was no evidence...
