Procedural Posture

Civil Appeal / Judgment

  1. 1 Whether the respondent was unfairly terminated from employment by the appellant.
  2. 2 Whether the respondent was entitled to the reliefs sought, including compensation, notice pay, and punitive damages.

Ratio Decidendi

The Court of Appeal found that the respondent did not resign but was forced out of employment without being given notice or a fair opportunity to respond to allegations, in violation of Sections 41 and 43 of the Employment Act. The appellant failed to discharge its statutory burden to justify the termination. The trial court's award of 12 months' salary as compensation for unfair termination was within its discretion and supported by the respondent's unblemished record and lack of disciplinary issues. The award of three months' salary in lieu of notice was also proper and did not amount to double compensation, as both remedies are distinct and may be awarded concurrently under Section 49....

Court Disposition

Appeal partly succeeds; punitive damages set aside; all other awards affirmed.

Orders

  • The award of Kshs.100,000 to the respondent for violating section 51(3) of the Employment Act is set aside and substituted with an order that the appellant issues the respondent a certificate of service within 30 days.
  • All other awards issued by the trial court are affirmed.
