Ratio Decidendi

As such, the tenancy does not meet the statutory definition of a controlled tenancy under section 2 of Cap 301. Consequently, the Tribunal lacks jurisdiction to hear and determine the matter. The applicant's reference and chamber summons were dismissed with costs to the respondent, and any interim orders previously issued were discharged.
