The court found that the application for stay of execution was filed without delay and that the respondent had not provided any affidavit of means or evidence of her financial capacity to refund the decretal sum if the appeal succeeded. The applicants' apprehension of substantial loss was therefore reasonable. Although the bank guarantee offered as security had expired, the court considered the need to balance the interests of both parties. The court granted a conditional stay of execution, requiring the applicants to pay one third of the decretal sum to the respondent and to deposit the balance in a joint interest earning account, failing which the stay would lapse.
