In 1985, Isaac Kiiru sold his interest in the compensatory land to the Appellant, Mahiga Children’s Home, and expressly requested the County Council to transfer the land to the Appellant. The court held that the Respondent's subsequent registration as proprietor was improper, as her predecessor had already disposed of his interest in the land.
