Ratio Decidendi

The court found that while an advocate may have a right to exercise a lien over client funds for unpaid fees, this right is not absolute and cannot be exercised arbitrarily. The respondent failed to render a cash account or notify the applicant of any fees due, and did not provide evidence of other transactions or fee entitlement. The applicant's case was uncontroverted, and the respondent could not withhold the Kshs 1,450,000 without proper accounting or fee notification. The court held that the applicant was entitled to an account, refund of any monies due, and interest from 5th September 2009.
