Ratio Decidendi

The court found that while the respondent may have had valid reasons to dismiss the claimant, the failure to accord him a hearing before dismissal contravened Section 41 of the Employment Act, Article 50(1) of the Constitution, and international labour standards. The process followed by the respondent was procedurally unfair, rendering the dismissal unfair and unjustified. The court converted the summary dismissal to a normal termination and awarded the claimant compensation for unfair termination, including one month’s salary in lieu of notice and twelve months’ salary as compensation.
