Commercial Appeal / Ruling on Stay Application Pending Appeal

  1. 1 Whether a stay of execution can be granted against a negative order.
  2. 2 Whether the applicant complied with section 560(1)(d) of the Insolvency Act before instituting proceedings.
  3. 3 Whether the application for stay is properly before the court given the insolvency context.

Ratio Decidendi

The court found that the applicant was seeking a stay of a negative order, which is incapable of execution and therefore cannot be stayed. The court relied on established case law holding that only positive orders requiring a party to do or refrain from doing something are capable of being stayed. Additionally, the court held that the applicant failed to comply with section 560(1)(d) of the Insolvency Act by not obtaining the consent of the administrator or the court before instituting the proceedings. As a result, the application and the proceedings were improperly before the court. Consequently, the application for stay was dismissed.
