The court held that the plaintiff had established a proper basis for the production of the counterpart of the transfer dated 5th June, 1996. The evidence showed that the original transfer could not be traced despite efforts, and the counterpart, which was also executed and stamped, was in the possession of the plaintiff's witness. Under section 65(2) and (3) of the Evidence Act, a counterpart executed in several parts is primary evidence. The court found that the witness, as the person in possession of the counterpart, was competent to produce it.
