Ratio Decidendi

The Supreme Court found that the 16th Respondent's preliminary objection did not raise a pure point of law as required by established jurisprudence and therefore failed. On the substantive application, the Court held that the 16th Respondent had not filed an appeal within the prescribed timelines after lodging the notice of appeal, nor had he obtained certification for the matter as one of general public importance. There was no evidence of compliance with the procedural requirements under the Supreme Court Rules. Consequently, the Court exercised its jurisdiction under Rule 37(1) to deem the notice of appeal withdrawn and allowed the application, with costs to the applicants.
