The High Court held that, following the 2015 amendment to Section 48(1) of the Law of Succession Act by the Magistrates' Courts Act, magistrates now have jurisdiction to hear and determine applications for revocation or annulment of grants they have issued, provided the value of the estate does not exceed the pecuniary jurisdiction prescribed under section 7(1) of the Magistrates' Courts Act. The court further clarified that Rule 44 of the Probate and Administration Rules, which restricts such applications to the High Court, is subsidiary legislation and cannot override the express provisions of the Act.
