The Court of Appeal held that the appellants lacked standing to sue as they were not parties to the transaction, nor did they establish themselves as beneficiaries or settlors of any trust. The evidence showed that the donation for the purchase of the property was made by the 1st appellant’s wife, who neither testified nor was joined as a party. There was no evidence of an express or resulting trust in favour of the appellants.
