The court found that the applicant had filed the application for stay of execution timeously and that the existence of an appeal was a sufficient reason to grant stay to prevent the appeal from being rendered nugatory. The court considered the need for security for the decretal sum and accepted the applicant's willingness to deposit the decretal sum in a joint interest earning account in the names of the advocates for both parties. The court concluded that the application was merited and allowed stay of execution on the condition that the decretal sum be deposited within 90 days, failing which execution could proceed.
