Ratio Decidendi

The court found that the defendant's letters to the plaintiff constituted clear, unequivocal admissions of indebtedness for the sum of Kshs 59,742,061.39. The admissions were not diminished by the defendant's subsequent denials or explanations in the defence. Applying Order 13 Rule 2 of the Civil Procedure Rules and the principles from Choitram v Nazari and Cassam v Sachania, the court held that there was no need for a trial on the admitted sum, as the admissions were plain and obvious. Judgment was therefore entered for the plaintiff for the admitted amount, with the balance of the claim (interest) to proceed to trial. Costs of the application and suit were awarded to the plaintiff.
