Ratio Decidendi

The court found that the decretal sum was deposited in compliance with a court order for stay of execution pending appeal. The appeal was subsequently dismissed for want of prosecution, and no steps have been taken by the appellant to challenge or set aside the dismissal. As the purpose for which the money was deposited has lapsed, and there is no pending appeal or application, it is just and fair that the deposited sum be released to the respondent. The application for release of the funds is therefore granted as prayed, with costs to the respondent.
