The Court of Appeal held that Order V rule 1 of the Civil Procedure Rules sets a strict limit on the validity and extension of summons: original validity is 12 months, extendable up to a maximum of 24 months from the date of issue, provided proper application is made. In this case, the original summons expired without extension, and the purported re-issue and service of fresh summons after expiry was invalid. The court's inherent powers under section 3A of the Civil Procedure Act cannot override or cure such a fundamental procedural defect.
