Procedural Posture

Employment Cause / Judgment

  1. 1 Whether the Claimant was an employee or an independent consultant.
  2. 2 Whether the Respondent had valid reasons to terminate the Claimant.
  3. 3 Whether due process was followed in the termination of the Claimant.

Ratio Decidendi

The court found that the Claimant was an employee and not a consultant, based on the appointment letter, regular salary, and the Respondent's control over his work. The Respondent failed to provide valid reasons for termination and did not follow due process, as the Claimant was not given any warnings or an opportunity to be heard. The termination was therefore unfair and unjustified under Sections 41, 43, and 45 of the Employment Act. The Claimant was awarded one month's salary in lieu of notice and twelve months' salary as compensation for unfair dismissal. The claim for service pay was denied as the Claimant was a member of NSSF.

Court Disposition

Claim allowed in part; termination declared unfair; compensation awarded.

Orders

  • Respondent to pay Claimant one month's salary in lieu of notice (Kshs. 60,000).
  • Respondent to pay Claimant twelve months' salary as damages for unfair dismissal (Kshs. 720,000).
