The High Court found that, despite statutory immunities and the doctrine of separation of powers, it retains jurisdiction to review County Assembly actions for constitutionality. The Court determined that the session of 27th September 2023 was convened in contravention of mandatory Standing Orders, as there was no evidence of gazettement or proper notice, and the Respondents failed to produce the Assembly calendar or Hansard to rebut the Petitioner’s claims. The failure to follow prescribed procedures rendered the session and the resulting suspension of the Petitioner unlawful, illegal, and unconstitutional.
