Ratio Decidendi

The court found that the applicant moved the court within the prescribed fourteen days and was therefore entitled to leave to appeal the ruling dated May 5, 2022. However, the court held that the order sought to be stayed was a negative order, merely dismissing the application with costs, and thus incapable of execution except as to costs. Since there was no evidence that a decree or certificate of costs had been drawn, and no demonstration that the respondent would be unable to refund costs if the appeal succeeded, the application for stay of execution was premature and without merit. The court accordingly granted leave to appeal but declined to grant a stay of execution.
