However, on the issue of quantum, the court determined that the trial court's award of Kshs. 1,000,000 in general damages was excessive when compared to recent and relevant authorities involving similar injuries. The court reduced the general damages to Kshs. 900,000, upheld the special damages of Kshs. 7,050, and, after applying the 50% liability apportionment, awarded a total of Kshs. 453,525 to the respondent.
