The Court of Appeal held that the Industrial Court established under the repealed Trade Disputes Act was a subordinate court created pursuant to an Act of Parliament and therefore subject to the supervisory jurisdiction of the High Court under the former Constitution. The ouster clause in section 17 of the Trade Disputes Act did not preclude the High Court from reviewing decisions made in excess of jurisdiction. The dispute between the appellant and the 1st respondent was indeed a trade dispute within the meaning of the Act, as it concerned terms of employment and remuneration.
