Ratio Decidendi

The Court of Appeal found that the applicant had satisfied both limbs required for the grant of stay of execution under Rule 5(2)(b): the intended appeal was arguable, raising substantive issues of law and fact regarding entitlement to service gratuity and locus standi, and the appeal would be rendered nugatory if stay was not granted, as recovery of the substantial decretal sum from 67 grievants, whose whereabouts were unknown, would be difficult if the appeal succeeded. The court therefore granted the stay of execution pending determination of the intended appeal, with costs of the application to abide the outcome of the appeal.
