The absence of a supporting affidavit meant the application lacked material support and could not be cured as a mere technicality. Even if the court were to consider the merits, the procedural history showed that delays were attributable to the transfer of the file between courts and the COVID-19 pandemic, not to a lack of interest by the appellant.
