The Court of Appeal found that the applicant had satisfied both limbs required for the grant of stay of execution under rule 5(2)(b) of the Court of Appeal Rules. First, the applicant demonstrated that the appeal was arguable, particularly on the issue of whether the trial court erred in awarding a sum greater than what was pleaded and proved by the respondent. Second, the court was persuaded that if stay was not granted and the sums were paid out, the appeal would be rendered nugatory should it succeed, as there was no assurance that the respondent could refund the amount. The court therefore exercised its discretion to grant the stay pending appeal.
