The court found that the power to grant stay of execution pending appeal is discretionary and should be exercised to ensure that an appeal is not rendered nugatory. The applicant did not demonstrate the potency of the appeal nor attach a memorandum of appeal, but offered to provide security for the decretal sum. The court held that justice required the respondent to partly enjoy the fruits of her judgment while securing the remainder pending appeal. Therefore, the court ordered the applicant to pay half the decretal sum to the respondent and deposit the other half in a joint interest-earning account, with stay of execution lapsing if these conditions were not met within 30 days.
